MIST Kizuki 利用規約

エム・アイ・エス・テクノロジー株式会社（以下「当社」といいます）は、当社が提供する ブラウザ拡張機能「MIST Kizuki」（以下「本サービス」といいます）の利用条件を、 次のとおり定めます。

第1条（適用）

1. 本規約は、本サービスの利用に関する当社とお客様との間の一切の関係に適用されます。
2. お客様は、本サービスをご利用になることにより、本規約に同意したものとみなします。

第2条（本サービスの内容）

1. 本サービスは、お客様が対応するAIサービス（ChatGPT および Claude）へ送信しようとする 文章と、AIサービスから表示された回答について、お客様の端末の中で確認を行い、 機密情報・個人情報・認証情報などが含まれている可能性をお知らせするものです。
2. 確認および置き換え（マスキング）の処理は、すべてお客様の端末の中で行います。 当社は、お客様がAIサービスへ送信する文章および表示された回答を受け取りません。
3. 本サービスは、添付ファイルの中身を確認しません。

第3条（アカウント）

1. 本サービスのご利用には、メールアドレスの登録が必要です。
2. ログインは、登録されたメールアドレスへお送りする6桁の確認コードにより行います。
3. お客様は、登録したメールアドレスおよび確認コードを適切に管理するものとします。
4. 1つのアカウントでご利用いただける端末は、3台までです。 端末の登録は、本サービスの画面からいつでも解除できます。

第4条（無料体験）

1. 当社は、初めてご登録いただくお客様に、14日間の無料体験を提供します。
2. 無料体験のお申し込みに、クレジットカードの登録は必要ありません。
3. 無料体験は、期間の満了により自動的に終了します。 自動的に有料プランへ移行することはありません。
4. 無料体験は、お一人につき1回限りとします。
5. 無料体験の期間中に有料プランへお申し込みいただいた場合、その時点で有料プランが開始し、 お支払いが発生します。残りの無料体験の期間は終了します。

第5条（有料プラン）

1. 有料プラン（Pro）の料金は、次のとおりです（いずれも消費税を含みます）。 - 月額プラン: 980円 - 年額プラン: 9,800円
2. 有料プランをお申し込みいただくと、本サービスのすべての機能をご利用いただけます。

第6条（支払いと提供の時期）

1. 有料プランの料金は、前条に定めるとおりとします。
2. 支払方法はクレジットカードとし、決済代行会社（Stripe, Inc.）を通じて行います。
3. 初回のお支払いはお申し込みのときに発生し、以後、月額プランは毎月おなじ日、 年額プランは毎年おなじ日に自動で更新・請求されます。
4. 本サービスは、お支払いの完了後、お客様のアカウントへ契約の状態が反映された時点からご利用いただけます。反映されない場合は、お問い合わせ窓口へご連絡ください。
5. お客様は、本サービスの画面の［契約の管理］から、いつでも解約できます。 解約されたあとも、お支払い済みの期間が終わるまでは有料プランをご利用いただけます。

第7条（禁止事項）

お客様は、本サービスのご利用にあたり、次の行為を行ってはなりません。

1. 法令または公序良俗に違反する行為
2. 当社または第三者の権利を侵害する行為
3. 本サービスの運営を妨げる行為
4. 本サービスを不正に利用する行為
5. 本サービスの複製・改変・解析を行う行為（法令により認められる範囲を除きます）
6. その他、当社が合理的な理由により不適切と判断する行為

第8条（免責）

1. 本サービスは、送信前の文章および表示された回答について、機密情報らしきものを 見つけてお知らせするものです。当社は、すべての機密情報を見つけられること、 および情報の漏えいを完全に防げることを保証しません。
2. 本サービスは、添付ファイルの中身を確認しません。
3. 対象のAIサービス（ChatGPT・Claude）の画面の作りが変わるなどの理由により、本サービスが 一時的に正しく動作しないことがあります。当社が検知できた場合には、画面上その他 合理的な方法によりお知らせするよう努めますが、すべての不具合を検知し、またはお知らせ できることを保証するものではありません。
4. 送信する内容の最終的な確認は、お客様が行うものとします。
5. 本条は、当社の故意または重大な過失による損害について、当社の責任を免れるものでは ありません。 また、消費者契約法その他の法令により無効となる範囲では適用しません。

第9条（個人情報の取扱い）

本サービスにおける情報の取扱いは、別途定める 「プライバシーポリシー」によります。

第10条（本サービスの変更・中止）

1. 当社は、本サービスの内容を変更し、または提供を中止することがあります。
2. 前項の変更・中止を行う場合、当社は、合理的な方法によりあらかじめお知らせします。 ただし、緊急を要する場合はこの限りではありません。
3. 有料プランのご利用期間中に本サービスの提供を中止する場合、当社は、 残りの期間に応じた金額を返金します。

第11条（本規約の変更）

1. 当社は、本規約を変更することがあります。
2. 本規約を変更する場合、当社は、変更後の内容および効力発生時期を、 合理的な方法によりあらかじめお知らせします。
3. お客様が変更後も本サービスをご利用になった場合、変更後の本規約に同意したものとみなします。

第12条（言語）

本規約は日本語を正文とします。参考のために他の言語の訳文を提供することがありますが、 解釈に相違がある場合は日本語版が優先します。

第13条（準拠法および管轄）

1. 本規約の準拠法は日本法とします。
2. 本規約に関する紛争については、東京地方裁判所を第一審の専属的合意管轄裁判所とします。 ただし、お客様が消費者である場合、法令により認められる裁判所への訴えの提起を妨げません。

MIST Kizuki Terms of Service

エム・アイ・エス・テクノロジー株式会社 ("we", "us") sets out below the terms on which you may use our browser extension "MIST Kizuki" (the "Service").

1. Application

1. These Terms apply to all dealings between us and you regarding the Service.
2. By using the Service, you are treated as having agreed to these Terms.

2. What the Service does

1. The Service checks, on your own device, the text you are about to send to a supported AI service (ChatGPT and Claude) and the answers those services display, and tells you when they may contain confidential information, personal data, or credentials.
2. Checking and masking happen entirely on your device. We do not receive the text you send to an AI service, nor the answers it displays.
3. The Service does not inspect the contents of attached files.

3. Account

1. An email address is required to use the Service.
2. You sign in with a 6-digit code sent to your registered email address.
3. You are responsible for looking after your email address and sign-in codes.
4. One account may be used on up to three devices. You can remove a device at any time from within the Service.

4. Free trial

1. New users are offered a 14-day free trial.
2. No credit card is required to start the trial.
3. The trial ends automatically when the period expires. It does not convert to a paid plan by itself.
4. One trial per person.
5. If you subscribe to the paid plan while your free trial is running, the paid plan starts at that point and you are charged then. Any remaining trial period ends.

5. Paid plan

1. The paid plan (Pro) costs (consumption tax included): - Monthly: JPY 980 - Yearly: JPY 9,800
2. Subscribing gives you access to all features of the Service.

6. Payment and when the Service becomes available

1. Prices are as set out in the previous article.
2. Payment is by credit card, processed through our payment provider (Stripe, Inc.).
3. The first payment is taken when you subscribe. After that, the monthly plan renews and is charged on the same day each month, and the yearly plan on the same day each year.
4. The Service becomes available once your payment has completed and the subscription status has been applied to your account. If it is not applied, please contact us.
5. You may cancel at any time from [Manage subscription] within the Service. After cancelling, you may keep using the paid plan until the end of the period you have already paid for.

7. Prohibited conduct

You must not:

1. break the law or act contrary to public order and morals;
2. infringe our rights or those of any third party;
3. interfere with the operation of the Service;
4. use the Service improperly;
5. copy, modify, or reverse-engineer the Service (except to the extent permitted by law); or
6. do anything else we reasonably consider inappropriate.

8. Disclaimer

1. The Service finds and flags things that look like confidential information in the text you are about to send and in the answers shown to you. We do not warrant that it finds every piece of confidential information, nor that it completely prevents information from leaking.
2. The Service does not inspect the contents of attached files.
3. The Service may temporarily not work correctly, for example if a supported AI service (ChatGPT or Claude) changes how its screen is built. Where we are able to detect this, we will endeavour to tell you on screen or by another reasonable method, but we do not warrant that we can detect, or give notice of, every such problem.
4. You remain responsible for the final check of what you send.
5. Nothing in this article excuses us from liability for damage caused by our intent or gross negligence. This article also does not apply to the extent it would be void under the Consumer Contract Act or other applicable law.

9. Personal data

How we handle information is set out in our Privacy Policy.

10. Changes to, and discontinuation of, the Service

1. We may change the Service or stop providing it.
2. If we do, we will tell you in advance by a reasonable method, except where the matter is urgent.
3. If we stop providing the Service while you are on a paid plan, we will refund the amount corresponding to the remaining period.

11. Changes to these Terms

1. We may change these Terms.
2. If we do, we will announce the new text and when it takes effect, in advance, by a reasonable method.
3. If you continue to use the Service after that, you are treated as having agreed to the new Terms.

12. Language

The Japanese version of these Terms is the authoritative text. Translations may be provided for reference; if there is any difference in interpretation, the Japanese version prevails.

13. Governing law and jurisdiction

1. These Terms are governed by the laws of Japan.
2. Any dispute relating to these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance. However, if you are a consumer, this does not prevent you from bringing proceedings in a court permitted by law.
